TERMS AND CONDITIONS FOR GOODS SOLD BY RHSPORTS PTY LTD FROM RHSPORTS.COM.AU

These Terms and Conditions constitute a legally binding contract between the customer (“you”) and RHSports Pty Ltd (ABN 85 108 820 828) (“RHSports Pty Ltd”) and apply to the ordering purchase, fulfilment and delivery of goods (“Goods”) from www.rhsports.com.au. By placing an order for Goods from RHSports Pty Ltd you agree to these Terms and Conditions.

Please read the following Terms and Conditions carefully before placing your order. The Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of Goods.

  1. DEFINITIONS

    In these Terms and Conditions:

    • “Account” means a personal or business account created on the Website;
    • “Additional Delivery Charge” has the meaning given in Section 3.4;
    • “Delivery Charge” has the meaning given in Section 3.3;
    • “International Delivery Charges” has the meaning given in Section 3.5;
    • “Order” means an order for Goods, placed on the Website;
    • “Password” means the password needed to access your Account;
    • “Website” means www.rhsports.com.au
  2. YOUR LEGAL RIGHTS

    Your purchase of Goods will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Goods must be of acceptable quality, reasonably fit for the purpose that RHSports Pty Ltd represents they will be fit for, and that the Goods will correspond with any relevant description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

  3. PRICING & TAXES

    1. Prices for Goods are as shown on the Website.
    2. RHSports Pty Ltd reserves the right to change the prices of Goods at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by RHSports Pty Ltd.
    3. In addition to the price for the Goods, you will also need to pay the advertised delivery charge (if any) (“Delivery Charge”). Any Delivery Charge will appear in your shopping cart.
    4. In addition to the price for the Goods and the Delivery Charge (if any) you may also need to pay any additional delivery charges which are not shown in your shopping cart but which we incur because you live in an area where light aircraft or barge transport is required, or to which our national courier company does not provide a door-to-door service (“Additional Delivery Charge”). These include, without limitation, Christmas Island, Norfolk Island, Roma and Nhulunbuy. Such charges may apply even where the item is shown on the Website as having “free delivery”, “free freight” or something similar. If you live in an area to which an Additional Delivery Charge will apply RHSports Pty Ltd will contact you before accepting your Order and provide you with a quote for the Additional Delivery Charge. If, within the timescale specified, you do not agree to accept the Additional Delivery Charge, RHSports Pty Ltd will refund your Order.
    5. RHSports Pty Ltd is not able to deliver outside of Australia and New Zealand.
    6. By placing an Order you agree to pay the price for the Goods, any Delivery Charge, any Additional Delivery Charge and any International Delivery Charge.
    7. Unless you are logged in on a registered trade customer account, all prices and Delivery Charges, Additional Delivery Charges and International Delivery Charges quoted are in Australian dollars and are inclusive of GST. Logged in Trade customers view ex GST pricing.
    8. To place an order on the RHSports Website, you will need to fill in all the required customer details, either as a Guest, or set up an account.
  4. YOUR ACCOUNT

    1. If you do not already have an Account you will need to create one.
      1. Personal Accounts can be created via the website
      2. Trade Accounts can only be created via RHSports upon application
    2. You may not set up an Account for someone else.
    3. Please ensure that you enter all information carefully when creating an Account. You warrant to RHSports Pty Ltd that all information provided by you in relation to your Account is complete, true and accurate
    4. You must notify RHSports Pty Ltd immediately if you become aware of any actual or potential unauthorised use of your Password or Account.
    5. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of: (i) your Account information being incomplete or inaccurate; or (ii) any unauthorised use of your Password or Account which takes place before you notify RHSports Pty Ltd, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
    6. If RHSports Pty Ltd suffers any loss, damage, cost or expense as a result of any unauthorised use of your Password or Account which takes place before you notify RHSports Pty Ltd then you must pay RHSports Pty Ltd the amount of that loss, damage, cost or expense if RHSports Pty Ltd asks you to.
  5. ORDERS

    1. You can place an Order by following the instructions on the relevant RHSports Pty Ltd website.
    2. An Order submitted by you is an offer by you to purchase the Goods for the price plus the Delivery Charge (if any) as shown at the time of submission of your Order and any applicable Additional Delivery Charge or International Delivery Charge. RHSports Pty Ltd may accept or reject your offer in its absolute discretion.
    3. Each Order that you place will, if accepted by RHSports Pty Ltd, be a separate and binding agreement between you and RHSports Pty Ltd with respect to the supply of the relevant Goods, in accordance with these Terms and Conditions.
    4. If you place an Order for someone else to receive the Goods you must obtain their consent before providing RHSports Pty Ltd with their personal information and, by placing an Order, you confirm to RHSports Pty Ltd that you have done this.
    5. Please ensure that you enter all information carefully when placing an Order. You warrant to RHSports Pty Ltd that all information provided by you in relation to each Order is complete, true and accurate.
    6. Please check your Order carefully (including the quantities ordered) before submitting it as Orders may not be able to be changed or cancelled once the Order has been accepted by RHSports Pty Ltd. RHSports Pty Ltd will use reasonable endeavours to cancel or change the Order if it has not already been shipped but makes no representation that it will be able to do this.
    7. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your Order information being incomplete or inaccurate or as a result of being unable to change or cancel your Order once it has been accepted by RHSports Pty Ltd, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all .
    8. Where you place separate Orders the Goods will be delivered separately and a separate Delivery Charge (and Additional Delivery Charge/ International Delivery Charge if applicable) will apply to each Order. RHSports Pty Ltd cannot consolidate separate Orders into one delivery.
    9. Where you order more than one item in one Order, all Goods for which your Order is accepted at the same time will be dispatched together where practicable. However, in some cases Goods may be dispatched separately, for example: in order to ensure that you receive each of the Goods as promptly as possible; where the goods are being dispatched from different locations.
    10. The internet can be an unstable, and sometimes insecure, marketplace. At times the facility to place Orders may not be available, your Order might not be received, your Order may be lost or misdirected, or your Order might be delayed.
    11. You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system, and contains appropriate protection to prevent damage to your computer system caused by viruses, malicious computer code or other forms of interference.
    12. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense arising out of or in connection with of any of the events set out in Section 5.13 or arising out of or in connection with you accessing the Website, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
  6. AFTER YOU HAVE SUBMITTED AN ORDER / PAYMENT

    1. When you submit an Order you will receive an Order reference number via e-mail.
    2. RHSports Pty Ltd will process payment for your Order when, or shortly after, you place your Order (except to the extent set out in clause 3.4). Your Order is deemed to be accepted by RHSports Pty Ltd when RHSports Pty Ltd does this, however RHSports Pty Ltd may, in certain circumstances, cancel your Order after acceptance as set out in these Terms & Conditions. In the event that RHSports Pty Ltd cancels your Order having already processed payment, it will refund payment in accordance with Section 13.1.
    3. When RHSports Pty Ltd accepts an Order it represents an agreement by RHSports Pty Ltd to supply the Goods to you in accordance with your Order subject to receiving payment from you and subject to these Terms and Conditions.
    4. You must pay for Goods by credit card (Visa or Mastercard), or other method as made available on the website or by RHSports Gift Card. If the name on the credit card/payment card/account does not match the name on the Order, RHSports Pty Ltd may ask you to provide additional information (for example, proof of identity documents) in accordance with its fraud detection processes. By providing your credit card/payment card/gift card you authorise RHSports Pty Ltd to deduct the price and the applicable delivery charge(s) from such card.
    5. RHSports Pty Ltd reserves the right to change the payment methods that can be used for Orders at any time in its absolute discretion.
    6. RHSports Pty Ltd may not be able to, or may decline to, accept payment from you by your nominated payment method at any time for any reason including, without limitation: (a) where our fraud detection systems detect possible irregularities; (b) because your financial institution has declined payment; or (c) because your payment card has expired. Where this is the case, your Order will be placed on hold and RHSports Pty Ltd will contact you to ask you to provide additional information (for example, proof of identity documents) or arrange payment by another method. If you are unable to comply with RHSports Pty Ltd’s requests within the timescale specified, RHSports Pty Ltd may cancel your Order.
    7. Goods that you have ordered will not be dispatched to you until your payment for the Goods has cleared. If your payment cannot be processed, your Order will be rejected and we will notify you by email.
  7. CANCELLATION OF ORDERS

    1. RHSports Pty Ltd reserves the right to cancel, at any time before delivery and for whatever reason, an Order that it has previously accepted. RHSports Pty Ltd may do this for example, but without limitation, where:
      1. RHSports Pty Ltd’s suppliers are unable to supply Goods that they have previously promised to supply;
      2. an event beyond RHSports Pty Ltd’s control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike or failure of computer systems, means that RHSports Pty Ltd is unable to supply the Goods within a reasonable time;
      3. Goods ordered were subject to an error on the Website, for example, in relation to a description, price or image, which was not discovered prior to the Order being accepted;
      4. you ask RHSports Pty Ltd to cancel your Order in accordance with section 5.8; or
      5. in the circumstances set out in Sections 3.4 or 6.9.
    2. You may cancel your Order where RHSports Pty Ltd:
      1. has breached a material term of this Agreement;
      2. is not able to deliver your Order within a reasonable time of the estimated delivery time advertised on the Website or as set out in these Terms and Conditions, other than a result of any delay for which you are wholly or partly responsible such as a failure to provide the correct delivery address or to pay for the Goods.
    3. Where RHSports Pty Ltd cancels your Order after acceptance it will send you an e-mail notifying you of cancellation.
    4. In the event of RHSports Pty Ltd or you cancelling your Order after payment has been processed, RHSports Pty Ltd will refund any money paid in respect of that Order. Section 13 of these Terms and Conditions sets out further information about refunds.
    5. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law) or as expressly set out in these terms and conditions, RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of cancellation of your Order, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
  8. AVAILABILITY OF GOODS/REFURBISHED STOCK

    1. RHSports Pty Ltd will try but cannot guarantee availability at all times. You acknowledge and agree that, from time to time, certain Goods may be out of stock or unavailable. RHSports Pty Ltd reserves the right to withdraw or suspend from sale any Goods displayed on the Website, either temporarily or permanently, at any time without notice to you. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of the unavailability of any Goods at any time, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
  9. DELIVERY

    1. Risk and title in Goods passes to you on the date and time of delivery of the Goods to the delivery address provided in your Order.
    2. Goods will generally only be delivered to addresses within Australia and New Zealand. RHSports Pty Ltd is unable to deliver to certain parts of Australia & New Zealand and where this is the case we will notify you by phone or email and refund your money.
    3. Where requested, RHSports Pty Ltd will deliver to PO Boxes in Australia where possible based on the size of the Goods. Where it is not possible to deliver the Goods to a PO Box and you have input a PO Box as the delivery address when placing your Order, RHSports Pty Ltd will call you to arrange an alternative delivery address
    4. Following dispatch of your Goods, RHSports Pty Ltd will email you with confirmation of dispatch and an invoice for your Order.
    5. On delivery you may be required to sign a proof of delivery document. If you are not available to take delivery, your Goods will be taken to a local depot or post office and a calling card containing the relevant contact details will be left at the delivery address.
    6. If you require Goods that you have ordered to be re-directed to an address which is not the original Order address RHSports Pty Ltd may charge you a reasonable fee for doing this.
    • In Stock – RHSports Pty Ltd aims to have the Goods dispatched to you within 3 business days (some goods will be dispatched significantly quicker than this).
  10. DELAY IN AVAILABILITY OR DELIVERY OF GOODS

    1. You agree and acknowledge that:
      1. RHSports Pty Ltd does not guarantee the delivery or availability of Goods within the timeframes set out in Sections Sections 9.7 – 9.10 or 10.3 above or otherwise specified by RHSports Pty Ltd or any of its staff;
      2. events outside RHSports Pty Ltd’ control may cause delays, or in some circumstances, prevent your Goods from being delivered or available for pick-up in store;
      3. delays are particularly likely to occur around Christmas, Easter and public holidays; and
      4. except to the extent expressly set out in these Terms and Conditions or otherwise required by law (including, without limitation, the Australian Consumer Law), neither RHSports Pty Ltd nor any of its agents will be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in delivery of the Goods to you or delay in the availability of Goods for pick up in store, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
  11. REFUNDS OF YOUR MONEY

    1. Where RHSports Pty Ltd is obliged to refund your payment pursuant to these Terms and Conditions, RHSports Pty Ltd aims to initiate your refund within 2 business days (Monday – Friday 9 a.m. to 5 p.m. Melbourne time). The additional time that it takes for you to actually receive your refund will depend upon how quickly your financial institution processes the refund.
    2. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RHSports Pty Ltd will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in you receiving any refund due to you, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
  12. RETURNS/FAULTY OR DAMAGED GOODS

      1. You should check your Goods as soon as they are delivered to you in order to ensure that: (i) they are what you ordered; and (ii) they are not damaged or faulty. If this is not the case you should contact RHSports Pty Ltd on info@RHSports.com.au as soon as possible.
      2. If you have a problem with any Goods or otherwise wish to return them please refer to RHSports Pty Ltd’s Returns Policy which forms part of these Terms and Conditions.
      3. When returning Goods:
        1. please provide RHSports Pty Ltd with your proof of purchase;
        2. it is a requirement for the fulfilment of refunds, exchanges and warranties that Customers use their best endeavours to return all products in good condition.

    Customers are also encouraged to use the original packaging where possible in order to avoid damage in transit.

    1. You are not entitled to any refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Goods themselves.
  13. MORE INFORMATION ABOUT RHSPORTS PTY LTD LIABILITY TO YOU

    1. To the full extent permitted at law, RHSports Pty Ltd is not liable for any loss of profit, loss of revenue, loss of business, loss of bargain, loss of savings, loss of data, loss or goodwill, loss of reputation, the cost of obtaining replacement or alternative goods or the cost of other remedial measures, or for any indirect, special, economic or consequential loss, arising in connection with any Order or Account.
  14. PRIVACY

    1. RHSports Pty Ltd policy on the collection, use and disclosure of customers’ personal information is set out in its Privacy Policy which forms part of these Terms and Conditions.
  15. WEBSITE TERMS

    1. Your use of the Website is governed by the Website Terms of Use.
  16. GENERAL

    1. RHSports Pty Ltd reserves the right to amend these Terms and Conditions at any time. Any amendment will take effect from the time that it appears on the Website. The Terms and Conditions which apply at the time that you place your Order are the Terms and Conditions which will apply to your Order.
    2. Any provision in this agreement which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of this agreement or affecting the validity or enforceability of that provision in any other jurisdiction.
    3. These Terms and Conditions are governed by the laws of Victoria, Australia

COMPETITION TERMS & CONDITIONS

RHSports – St Kilda Round 8 Guard of Honour Competition Terms and Conditions

All schools which enter the promo code SAINTSGOH24 on an order during the period 15 April 2024 to 24 April 2024 will be entered into the draw for a chance to win one prize of 6 student places on the St Kilda Guard of Honour for the Round 8 AFL match between St Kilda and North Melbourne, held at Marvel Stadium, Melbourne, VIC, at 4:35pm on 4 May 2024 (the “Guard of Honour”) (the “Promotion”).

Entry into the Promotion is available to schools who enter the code before 12pm on 24 April 2024. One winner will be randomly selected from valid entries. The winning school will be notified on or before 25 May 2024. The winning school will select 6 of its students aged between 4-14 years to participate in the Guard of Honour and must ensure that the parent/guardian of each student reads and agrees to these terms and conditions. The winning school will provide RHSports with the names of the selected students, parent/guardian contact details and required parent/guardian consent for each student by 29 April 2024. RHSports will provide these details to St Kilda FC and St Kilda FC will contact the parents/guardians direct to confirm logistical arrangements for the Guard of Honour before 30 April 2024. The Promotion is subject to the more detailed terms and conditions below.

RHS Sports – St Kilda Round 8 Guard of Honour Competition Detailed Terms and Conditions

  1. This document contains the terms and conditions of entry (“these terms”) into the RHSports – St Kilda Round 8 Junior Mascot Competition (“Promotion”). Adding the promo code to any order by a teacher, administrator or other staff member of a school will result in entry into the Promotion on behalf of that school and entry into the Promotion is deemed acceptance of these terms.
  2. The promoter of the Promotion is the Ross Hayward Sports Pty Ltd ABN 85 108 820 828 of Level 1, 122-126 Old Pittwater Road, Brookvale NSW 2100 Australia (“RHSports/Promoter”).
  3. In these terms, the following meanings apply in addition to terms which are defined elsewhere in these terms unless the contrary intention appears:

“AFL” means the Australian rules football competition which is conducted by the Australian Football League (AFL) in Australia between member teams of the AFL.

“Eligible Entrant” means a person who is eligible to participate in and has submitted an entry into the Promotion in accordance with clauses 4 to 7 (inclusive) of these terms and includes the school on whose behalf any entry is completed.

“Entrant” means a person who is eligible to participate in and has submitted an entry into this Promotion in accordance with these Terms.

“Promotion Period” means the period defined in clause 9 of these terms.

“Judging Location” means the premises located at 21 Brunswick Road, Brunswick Eat, Vic, 3057

 “Website” means the designated website of the Promoter for the Promotion.

Entrants must enter the promo code and complete an order of RHSports equipment by 5pm on 24 May 2024.

  1. Entry is open to schools whose teachers, staff and/or administrators enter the promo code on a valid order, (“Eligible Entrants“).
  2. Parents/guardians of students selected by the winning school to participate in the Guard of Honour may be required by the Promoter to enter into a further agreement as additional evidence of consent to these terms and conditions and to the minor participating in the Guard of Honour.
  3. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period, enter the promo code and complete an order on the RHSports website.
  4. The Promoter reserves the right to not accept a survey for any Eligible Entrant or to disqualify an Eligible Entrant if the Promoter reasonably considers that the survey contains anything fraudulent, defamatory or is otherwise in contravention of these terms and conditions.

Promotional Period

  1. The Promotion will be open from 9:00am, Australian Eastern Standard Time (“AEST”) on Monday 15 April 2024 and will close at 12pm Australian Eastern Standard Time (“AEST”) on Wednesday April 24 (“Promotion Period“).

Prize”

  1. There is one prize available as part of the Promotion (“Prize”), which contains:
  • 2 x 6 Adult (Parent/guardian) + 1 x 6 Child General Admission tickets to Round 8 St Kilda v North Melbourne at Marvel Stadium on May 4 2024
  • Opportunity for 1 x 6 student (4– 14 years old) to participate in St Kilda Guard of Honour for the Round 8 St Kilda v North Melbourne, held at Marvel Stadium, Melbourne, VIC, at 4:35pm on 4 May 2024
  • Any costs associated with attending the above match including travel expenses and meals will be the responsibility of the winner.
  1. The winning school will select 6 of its students aged between 4-14 years to participate in the Guard of Honour and must ensure that the parent/guardian of each student reads and agrees to these terms and conditions. The winning school will provide the Promoter with the names of the selected students, parent/guardian contact details and required parent/guardian consent for each student by 29 April 2024.   1. A Prize cannot be transferred, exchanged or redeemed for cash.
  2. The winner will be chosen at random by a representative of the Promotor at 1:00pm at the Judging Location on Wednesday April 24 2024
  3. The winner of each Prize will be contacted in writing within 24 hours of the Prize winner being selected.
  4. If a Prize is unavailable for whatever reason, the Promoter, in its sole discretion, reserves the right to substitute the Prize for a prize of equal or greater monetary value.

General

  1. The total prize pool for this promotion is valued at $250 per person (including GST).
  2. Judging of all prizes will be conducted by a representative of the Promoter as set out in 12 above.
  3. The judges’ decision for all prizes in this Promotion is final and binding and no correspondence will be entered into.
  4. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements and must ensure that the parent/ guardians of each student selected by the school to participate in the Guard of Honour consents to their participation and must also comply with all these terms.
  5. It is a condition of accepting the prize that the winning school must ensure that the parent/ guardians of each student selected by the school to participate in the Guard of Honour consents to their participation and must also comply with all these terms.
  6. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  7. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash (or any substitute prize) will not be awarded in lieu of that element of the prize.
  8. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
  9. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  10. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
  11. Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
  12. It is a condition of taking a prize that the winner must, if requested to do so by the Promoter, sign and return documents relating to their eligibility to enter (including ownership of entry), statement of compliance with relevant terms and conditions and/or a release of the Promoter’s liability in taking prizes.

Limitation of Liability

  1. If for any reason this Promotion is not capable of running as planned (including if the Promotion is cancelled for any reason), including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures, or any other causes beyond the control of the Promoter which corrupt or affect administration security, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to compliance with any relevant laws, including State and Territory regulations.

The Promoter accepts no responsibility for any entries not received for any reason during the Promotion.  Entries will be deemed to be accepted at the time of receipt and not at the time of transmission.  No responsibility will be taken for lost, late or misdirected entries.  The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  3. If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value, subject to any directions given by State gaming departments.
